Decisions in Aviation Cases

Many aviation cases are settled without the intervention of the court. In many cases, these decisions are explained in detail to the persons concerned. In order to promote legal certainty, the PPS has decided to publish the decisions anonymously.

According to the PPS, publication of decisions relating to violations by persons or organisations in the manned and unmanned aviation can also be important for the promotion of Just Culture. In order to be fully transparent, in cases where such an interest is deemed to exist, every decision is in principle published after the case has been fully settled. In decisions in other cases, it is contemplated per case whether the publication is relevant.  

The PPS gives a unique ’ELOM number’ in the style of the European Case Law Identifier (ECLI). This number begins with the code ‘ELOM’, an abbreviation of ‘Expertisecentrum Luchtvaart OM’ (the Dutch name of the expertise centre). Thereafter, follows a year number when the decision has been taken and the publication number. The unique number of the decision is thus built up usually as follows: ELOM:year:number.

The decisions can be combed through. Use filters for searching on ELOM number, words from the title, date and/or case type*.
